1.1. Welcome to the website of the Society for the Advancement of Education Jerusalem (Amuta/Association), Registration No. 58-002811-6, available at: https://www.kidum-edu.org.il/ (the “Website”, “SAE”, or “We”).

1.2. SAE respects your privacy and is committed to protecting it when you use the Website. This Privacy Policy describes the types of personal information that may be collected from you or about you through your use of this Website only, the manner and purposes for which such information is processed (as defined below), and your rights in relation to your personal information (the “Privacy Policy”).

1.3. The collection and processing of personal information by SAE are carried out fairly, proportionately, only to the extent necessary, solely for the purposes set out in this Privacy Policy, and while implementing appropriate technical and organizational measures according to the level of risk. You are requested to read this Privacy Policy carefully. If you do not agree to its terms or do not accept it in full, please refrain from using the Website and/or from providing any personal information to SAE.

1.4. The current version of SAE’s Privacy Policy is available on the Website at all times and forms an integral part of the Website’s Terms of Use. The Privacy Policy may be updated from time to time to reflect changes in SAE’s activities. We therefore recommend reviewing this policy periodically. Material updates will be communicated through customary channels and in accordance with applicable law.

1.5. SAE operates several educational institutions and/or educational programs (the “Institutions” or “Projects”). Except for the “Advancing to Academia / Ra’uyim Le’Kidum” program, for which applications may be submitted through this Website (Form available in Hebrew), the remaining Institutions and Projects are subject to separate registration terms and legal arrangements. Registration or participation in such programs is carried out via dedicated websites for each Institution or Project (the “Dedicated Websites”). The applicable terms of use and privacy policies can be reviewed on those Dedicated Websites.

1.6. SAE hereby clarifies that You are not legally required to provide personal information to SAE. Providing personal information is voluntary and subject to your consent. However, failure to provide personal information, or providing incomplete or inaccurate information, may prevent SAE from responding to your inquiries, registering you for the “Advancing to Academia / Ra’uyim Le’Kidum” program, or granting access to certain areas of the Website. Providing false or misleading information may constitute a breach of the Website’s Terms of Use and/or a violation of applicable law.

1.7. This Privacy Policy is drafted in the masculine form for convenience only and applies equally to all genders.

2.Definitions

2.1. For the purposes of this Privacy Policy, the following terms shall have the meanings set out below, unless otherwise defined in the Terms of Use:

Personal Information” – Any information relating to an identified or identifiable individual, directly or indirectly, by reasonable means, including identification details, contact details, digital identifiers, usage data, and any other information as defined under applicable laws.

Processing” / “Use” – Any operation performed on personal information, including collection, receipt, storage, copying, review, disclosure, exposure, transfer, provision of access, or otherwise making information available.

3.Categories of Personal Information Collected by the SAE and Purposes of Processing

3.1. SAE collects and processes personal information that is required for the conduct of its activities and for achieving its public and educational objectives, such as responding to inquiries, receiving donations, completing registration processes, assessing candidacy for employment, and promoting and marketing its activities to relevant target audiences, or as required by applicable law.

3.2. Accordingly, during your use of the Website, browsing, submission of an application and/or form, inquiry, and/or any communication or contact with SAE, personal information necessary for the relevant inquiry or service may be collected, including personal details, payment-related information, contact details, and additional information, as detailed below.

3.3. For your convenience, the main processing activities are summarised in the table below.
With respect to individuals located in the European Economic Area (EEA), the table also specifies the applicable legal basis for processing under the GDPR .

All provisions relating to responsibility, consent, and processing of minors’ personal information shall apply in accordance with the “Minors and Guardianship” section of this Privacy Policy.

** Donations and payments for registration to the “Advancing to Academia/ Ra’uyim Le’Kidum” program are carried out through a secure payment page operated by the clearing company, in accordance with stringent security standards required of payment and clearing service providers and/or other services operating under the relevant standards (including SSL and PCI). The collection and processing of payment transaction details are the sole responsibility of the clearing company. SAE does not receive and/or store payment instrument details or payer details.

4.Information Security

4.1. Although SAE implements reasonable and commonly accepted technological and organizational measures, in accordance with applicable law and prevailing standards, to protect personal information, SAE cannot guarantee absolute protection against unauthorized access, intrusion, misuse, system failures, or other information security incidents.

4.2. Accordingly, SAE shall not be liable for any damage, loss, malfunction, or harm of any kind resulting from such information security incidents, including unauthorized access to personal information, loss, deletion, or corruption of information, unless such damage was caused by SAE’s gross negligence or willful misconduct, or by those acting on its behalf.

5.Transfer of Personal Information to Third Parties by SAE

5.1. SAE does not sell or trade your personal information. However, for the purpose of providing services through the Website and achieving SAE’s objectives, SAE works with strategic partners and external service providers (such as cloud service providers, information security providers, and academic institutions). SAE ensures that any transfer of personal information is limited strictly to what is necessary for the provision of the relevant service and undertakes that any such sharing shall be subject to the applicable law governing the processing of the relevant personal information. Additional information is provided below.

5.2. Without derogating from the above, SAE may transfer personal information to the parties listed below.

5.2.1. Service and Infrastructure Providers Engaged by SAE: SAE may transfer personal information to service and infrastructure providers that supply SAE with, inter alia:

i. Support and operational services for the Website, including its operation, security, and/or maintenance;

ii. Fraud prevention, information security services, and/or protection against cyberattacks and malicious activity;

iii. Cloud storage services and Software-as-a-Service (SaaS) platforms on which the Website is operated and/or hosted;

iv. Website maintenance, design, upgrades, and/or implementation of changes by SAE’s website designers and/or technical support providers;

v. Statistical analyses relating to the Website, the effectiveness of commercial or informational campaigns appearing on the Website, and/or assessment of the Website’s relevance to its users;

vi. Business management infrastructure services, including cloud-based systems for managing user information, data processing tools, office software providers, email services, and communication platforms; and

vii. Operation of customer service centers and/or responding to inquiries through the communication channels available on the Website.

5.2.2. Academic Institutions – Registration to the “Advancing to Academia / Ra’uyim Le’Kidum” Program:

i. Transfer of the personal information provided by you as part of your application to the “Ra’uyim Le’Kidum” program, including the results of the screening and ranking process carried out by SAE for the purpose of determining an affirmative action score, to universities or higher-education institutions, or their authorized representatives, in order to support your application for admission to such institutions.

5.2.3. Transfer of Personal Information to Third Parties for Legal Reasons and Compliance with Law: SAE may transfer personal information to third parties in the following circumstances:

i. Where SAE is required to do so pursuant to a judicial order or in the context of legal proceedings to which SAE is a party, whether initiated by you or otherwise;

ii. Where required in order to comply with any legal process, such as a search warrant, court subpoena, regulatory audit, or enforcement action by a competent regulator or administrative authority under any applicable law, or pursuant to any other legal obligation binding upon SAE. In such cases, SAE may disclose user information in accordance with the terms of the judicial order and/or the instructions of the enforcement or competent administrative authority, without obtaining your prior consent;

iii. Where necessary to enforce SAE’s rights under this Privacy Policy or under the Website’s Terms of Use, as a result of their violation by you, or in the event of any dispute, claim, demand, complaint, or legal proceedings between you and SAE (including its subsidiaries and/or affiliated entities) and/or any party acting on its behalf; and

iv. Where SAE is required to transfer its activities and/or the Website to the management of another entity, including in the event of a merger with another organization or a merger of SAE into another entity (the “Transferee”). In such case, SAE may transfer to the Transferee a copy of, or access to, the personal information stored by SAE, as well as any statistical information collected or processed by it, provided that the Transferee assumes all of SAE’s obligations toward you under this Privacy Policy and undertakes to act in accordance with its terms.

6.Transfer of Personal Information Outside the Borders of the State of Israel

6.1. Where personal information relating to you is transferred by SAE outside the country in which you reside, SAE shall act in accordance with the obligations applicable to it under the relevant law, including the Protection of Privacy Regulations (Transfer of Data to Databases Outside the State), 5761–2001, and/or the General Data Protection Regulation (EU) 2016/679 (GDPR).

6.2. This applies both with respect to the selection of the countries in which personal information is stored and to the existence of appropriate contractual arrangements with such third parties, designed to ensure the protection of your privacy and the security of your personal information.

6.3. The SAE does not sell personal information. Personal information may be shared with service providers, academic institutions, and authorities where necessary to fulfil the purposes described above, comply with legal obligations, or protect the SAE’s rights. Transfers outside Israel are carried out in accordance with applicable data protection laws, including the GDPR where relevant.

7.Links to Third-Party Websites and Other External Websites of SAE

7.1. This Website may include links to websites operated by third parties, for which SAE bears no responsibility whatsoever with respect to the content displayed on such websites and/or the level of privacy protection they provide. Accordingly, any use of, browsing on, or transition to third-party websites, including pages on social media platforms (the “Platforms”), is subject to the terms of use and privacy policies of those websites and platforms.

7.2. Before accessing or using such websites or platforms, it is recommended that you review their terms of use and/or privacy policies and exercise your own discretion accordingly.

8.User Rights in Relation to Personal Information

8.1. Right of Access (Review). Pursuant to Section 13 of the Protection of Privacy Law, you are entitled to review the personal information held about you in SAE’s databases, subject to an identity verification process and in a manner appropriate to the circumstances, all in accordance with applicable law.

8.2. Right to Rectification. In addition, pursuant to Section 14 of the Protection of Privacy Law, you are entitled to request the correction of personal information relating to you that is held in SAE’s systems, if such information is inaccurate, incomplete, unclear, or outdated. For the purpose of exercising this right, you may contact SAE and request that the information be corrected or, alternatively, deleted, in accordance with your rights under Section 14 of the Protection of Privacy Law.

8.3. In exercising these data subject rights, SAE shall provide a transparent response within the timeframes required by law. SAE may be unable to fulfil a request under this section if it does not hold sufficient information to verify your identity. In such case, SAE will inform you of the information required in order to proceed.

8.4. Additional Rights for EEA Residents

8.5. In addition, if you are located in the European Economic Area (EEA), SAE shall grant you the full set of rights in accordance with Chapter III of the General Data Protection Regulation (Regulation (EU) 2016/679 – GDPR), including:

a) the right to access your personal information;

b) the right to rectify inaccurate or incomplete personal information;

c) the right to erasure of personal information (“the right to be forgotten”), subject to the conditions set out in law;

d) the right to restrict or object to the processing of personal information;

e) the right to object to processing in certain circumstances, including processing based on legitimate interests or for direct marketing purposes; and

f) the right to data portability.

8.6. Where the processing of personal information is based on consent, you are entitled to withdraw your consent at any time, in accordance with Article 7(3) of the GDPR, without affecting the lawfulness of processing carried out prior to the withdrawal of consent.

8.7. Please note that, in the event of deletion or correction of personal information, SAE may no longer be able to correspond with you, respond to you, or contact you, in whole or in part. By submitting a request for deletion or correction as aforesaid, you irrevocably agree and confirm that you waive any claim or demand against SAE in connection with SAE’s inability to provide you with services through the Website as a result of exercising such request.

8.8. For your information, SAE does not knowingly make any decisions that may adversely affect you based solely on automated decision-making tools without human involvement. SAE undertakes that, should such decision-making be implemented, you will be given the opportunity to exercise your right to human intervention, to express your position regarding the decision concerning you, and to receive an explanation of the decision.

8.9. Filing a Complaint with a Data Protection Authority. If you believe that your rights have been infringed, you are entitled to submit a complaint to the data protection supervisory authority in your country of residence.

8.10. For any questions or information required in connection with SAE’s Privacy Policy, you are welcome to contact SAE using one or more of the contact methods detailed below, and SAE shall endeavour to respond to your inquiry promptly and in accordance with applicable law.

9.Data Retention and Deletion Policy

9.1. SAE retains your personal information for the period required to fulfil the purpose for which the information was collected (such as responding to an inquiry or processing a registration request), and in accordance with any legal requirements that mandate longer retention and processing periods (including management of consent withdrawal lists, user preference management, cooperation with competent authorities, etc.), based on the data subject’s consent and for the purpose of fulfilling the objectives, rights, and obligations set out in this Privacy Policy.

9.2. Accordingly, once the purpose for which the personal information was collected has expired, SAE shall cease using your personal information and shall take steps to delete or fully anonymise such information, unless otherwise required by law.

10.Minors and Guardianship

10.1. Where personal information relating to a minor is provided to SAE, the responsibility for providing such information, informing third parties, and obtaining any consent required by law shall rest with the minor’s parent or legal guardian.

10.2. The person providing the information declares and confirms that they are authorised to provide the information on behalf of the minor, and that all consents, approvals, and authorisations required by law have been obtained, including from any third parties whose information is provided as part of the registration or inquiry.

10.3. If SAE becomes aware that personal information relating to a minor has been collected in violation of this Privacy Policy, SAE shall take steps to delete such information as soon as possible, subject to applicable law and to any retention obligations imposed on SAE.

11. Miscellaneous

11.1. This Privacy Policy shall be governed by the laws of the State of Israel, and the courts in the Jerusalem District shall have exclusive jurisdiction over any claims, requests, or demands relating to this Privacy Policy.

11.2. If any provision of this Privacy Policy is found to be unlawful, invalid, or unenforceable, such finding shall not affect the validity or enforceability of the remaining provisions of this Privacy Policy. In such case, a valid and enforceable provision of similar effect shall be deemed to replace the provision that was invalidated or removed.
